Welcome to Pixelbook. By accessing or using pixelbook.io (the "Platform"), you agree to be bound by these Terms of Service. Please read them carefully. If you do not agree, do not use the Platform.
Pixelbook is currently in early access beta. Features and policies may change as the platform develops. We will notify users of any significant changes.
1. Who We Are
Pixelbook is a marketplace for pixel art game assets, connecting indie developers (buyers) with pixel artists and creators (sellers). The Platform is operated by Pixelbook (“we”, “us”, “our”).
2. Eligibility
You must be at least 16 years old to use Pixelbook. By registering, you confirm that the information you provide is accurate and that you have the legal capacity to enter into these terms.
3. Accounts
You are responsible for maintaining the security of your account and any activity that occurs under it. You must not share your signin credentials with others. Notify us immediately at support@pixelbook.io if you suspect unauthorised access to your account.
We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or are inactive for an extended period.
4. Buying Assets
When you purchase an asset on Pixelbook, you are purchasing a licence to use that asset as described on the listing page. You are not purchasing ownership of the underlying intellectual property.
Unless stated otherwise on the listing, the standard licence permits you to:
- Use the asset in personal and commercial game projects.
- Modify the asset for use within your own project.
- Use the asset in games distributed on any platform.
The standard licence does not permit you to:
- Resell, redistribute, or share the asset files as standalone art.
- Use the asset in AI training datasets.
- Claim the original asset as your own work.
All sales are final. We do not offer refunds on digital downloads unless the files are demonstrably corrupted or do not match the listing description. Refund requests should be submitted to support@pixelbook.io within 7 days of purchase.
5. Selling Assets
To sell on Pixelbook you must apply for a creator account. By listing assets you confirm that:
- You own the intellectual property rights to the assets you upload.
- The assets do not infringe any third-party copyright, trademark, or other rights.
- The assets are your original work and have not been generated solely by AI tools without significant human creative input.
- You have the right to grant buyers the licences described in your listings.
Pixelbook charges a commission on each sale. The current commission rate is displayed in your seller dashboard and may be updated with notice.
Payouts are processed via Stripe Connect. You are responsible for any taxes applicable to your earnings in your jurisdiction.
6. Prohibited Content
You must not upload or list assets that:
- Infringe the intellectual property of others (including fan art of copyrighted characters without permission).
- Contain offensive, hateful, or discriminatory content.
- Include sexually explicit material.
- Were generated entirely by AI without meaningful human creative contribution.
- Are stolen or plagiarised from other artists.
We reserve the right to remove any listing that violates these rules without notice and to terminate the accounts of repeat offenders.
7. Intellectual Property
All content you upload to Pixelbook remains your intellectual property. By uploading, you grant Pixelbook a non-exclusive, royalty-free licence to display, promote, and showcase your assets on the Platform and in marketing materials.
The Pixelbook name, logo, and Platform design are the property of Pixelbook and may not be used without written permission.
8. Disputes Between Buyers and Sellers
Pixelbook is a marketplace and is not a party to transactions between buyers and sellers. We will make reasonable efforts to mediate disputes but are not liable for the outcome. Disputes should be raised at support@pixelbook.io.
9. Limitation of Liability
To the fullest extent permitted by law, Pixelbook shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform. Our total liability shall not exceed the amount you paid to Pixelbook in the 12 months preceding the claim.
The Platform is provided “as is” during the beta period. We do not guarantee uninterrupted access or that the Platform will be free from errors.
10. Changes to These Terms
We may update these terms from time to time. We will notify registered users by email of any material changes. Continued use of the Platform after changes constitutes acceptance of the updated terms.
11. Governing Law
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
